DEGO PLATFORM – TERMS AND CONDITIONS

These Terms and Conditions constitute a legally binding agreement between you and Dego Technologies Sdn. Bhd. ("Dego", "we", "us", or "our"). They govern (A) the access or use of the Dego mobile application and related services by Customers ("Users") and (B) the provision of transportation services via the application by independent Drivers ("Drivers"). By creating an account, accessing, or using the Platform you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.  Definitions

Term
Meaning
Platform
The Dego mobile applications, websites, and related technology.
Booking
A confirmed request by a User for transportation services fulfilled by a Driver.
Platform Fee
A percentage of the total Booking value retained by Dego for service, support, and technology.
Driver Earnings
A percentage of Booking value, less applicable charges (e.g., wait‑time, tolls), paid to the Driver.
Affiliate Program
Optional referral program governed by separate Affiliate T&C.
Wallet
In‑app balance for holding payouts (Drivers) or credits (Users).
Service Region
Geographic areas in which Dego operates, as listed in‑app.

3.  Use of the Platform – Users

  1. Bookings: Users may request on‑demand or scheduled rides within the Service Region.
  2. Payment Authorisation: By confirming a Booking, you authorise Dego to charge your selected payment method for the quoted fare and any additional charges (wait‑time, tolls, surge).
  3. Cancellations: Cancellations made ≥3 minutes after Driver acceptance may incur a cancellation fee (see Section 6).
  4. Account Security: You are responsible for maintaining the confidentiality of login credentials and for all activity under your account.
  5. Prohibited Use: You may not: (a) use the Platform for unlawful transport of goods or persons; (b) harass Drivers; (c) attempt to reverse engineer the app.

4.  Use of the Platform – Drivers (Driver Addendum)

  1. Independent Contractor: Drivers are independent service providers, not employees or agents of Dego. Nothing herein creates an employment relationship.
  2. Service Standards: Drivers must (a) accept or decline Bookings promptly; (b) maintain a rating ≥4.5/5.0; (c) comply with local traffic laws; (d) ensure vehicle condition, cleanliness and roadworthiness.
  3. Availability: Drivers may go online/offline at their discretion but must accept a reasonable share of nearby requests to remain in good standing.
  4. Earnings & Payouts: Drivers earn a percentage of Booking value plus applicable wait‑time/toll surcharges minus platform‑authorised deductions. Payouts are credited to Wallet daily; bank transfers occur each Friday for balances RM50.
  5. Taxes: Drivers acknowledge sole responsibility for filing and paying any income tax, GST, or other levies arising from earnings.
  6. Insurance: Drivers must maintain valid motor insurance covering commercial passenger use and provide proof on request.
  7. Safety Incidents: Accidents or safety incidents must be reported to Dego within 24 hours via in‑app form.

5.  Bookings, Fees, and Payment

Up to 5 stops; fare recalculates dynamically.
Insurance Add‑On
Users may add trip insurance for an extra fee.

Payments are processed through licensed payment gateways; Dego does not store full card data.


6.  Cancellations and Refunds

9.  Intellectual Property

All Platform content, trademarks, and software belong to Dego or its licensors. You may not reproduce, modify, or create derivative works without written consent.


10.  Privacy & Data Protection

Personal data is processed in accordance with our Privacy Policy (available in‑app). By using the Platform you consent to such processing.


11.  Suspension & Termination

We may suspend or terminate access for breach of these Terms, fraudulent activity, or as required by law. Outstanding Wallet balances may be withheld pending investigation.


12.  Disclaimers & Limitation of Liability

The Platform is provided "as‑is" without warranties of any kind. To the maximum extent permitted by law, Dego shall not be liable for indirect, incidental, consequential, or punitive damages. Our aggregate liability shall not exceed the greater of (a) RM500 or (b) the total Platform Fees paid by you in the preceding three months.


13.  Indemnification

You agree to indemnify and hold harmless Dego, its affiliates, officers, and employees from all claims, damages, and expenses arising from your use of the Platform or breach of these Terms.


14.  Amendments

We may modify these Terms at any time by providing 14 days’ notice via email or in‑app notification. Continued use after the effective date constitutes acceptance.


15.  Governing Law & Dispute Resolution

These Terms are governed by the laws of Malaysia. Disputes shall first be resolved amicably; failing that, they shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur.
